RE: RENEWAL OF CC&Rs
PRIORITY: HIGH
Pine
Mountain Club—its residential charm, open spaces, and recreational
facilities—exists because of the guidelines and rules that govern our
community—our Covenants, Conditions, and Restrictions (CC&Rs). Together with our By-Laws, the CC&Rs
structure this development. This important document is up for renewal, and your
participation in that process is vital to the future of our community. Please review, suggest and, ultimately, approve
revised CC&Rs for our community.
When
adopted by the membership, the revised CC&Rs will:
Extend the life of PMC and its greenbelts as we now know it.
Conform to existing law.
Remove unneeded and expired provisions.
Clarify and update its various provisions to eliminate
language that has created controversies and incurred expensive lawsuits.
The
enclosed document is the July 26, 2007 draft revision of the CC&Rs. It incorporates suggestions made by owners
responding to the first draft revision circulated in 2004. As before, we encourage your comments and
suggestions, which will be considered in preparing the final document for your
approval. You may deliver your comments
in any of four ways:

proposed CC&R revisions is also enclosed
The proposed new wording appears in the left column with the presently
effective CC&Rs wording in the right column. Attached footnotes identify and explain
changes. This side-by-side comparison
can also be found on the Association website, along with directions on how to
get more information.
On
September 8, 2007 from 9 -12 noon, we invite you to attend a forum in the
Condor Room to discuss this revised document.
Please come and express your thoughts.
If you prefer, you may submit questions and comments by August 31, 2007
by mail, email or the CCC box in the clubhouse lobby, and we will make sure
they are discussed at this meeting. Any
subsequent CC&R revised drafts will be sent to you, and you will be
notified in advance of any future meetings to discuss such drafts. We seek and encourage full participation in
this important process.
